Do This Before Everything Else

Before you spend a single dollar on this business, before you form an LLC, before you file anything — you need to call your local zoning office.

Here’s what most courses don’t tell you: your state can make cottage food legal, and your town can still say no. Local zoning laws control what kinds of businesses are allowed to operate in residential zones. There are still municipalities where cottage food operations are not permitted in residential areas — regardless of what the state law says.

That means the very first action item in your binder isn’t your why. It’s your zoning check.

Exactly What To Do

1. Search “[your town name] zoning office” or call your city or county hall and ask to be connected to the zoning or planning department.
2. When you reach someone, ask this specific question: “Is a cottage food operation permitted in a residential zone in [your town]?”
3. Ask for their answer by email so you have documentation.

If They Say Yes

If They Say No

You need to know that now — not after you’ve invested months of work. Your options:

• Look into renting a licensed commercial kitchen
• Check if neighboring towns have different zoning rules
• Advocate for a zoning variance
